TERMS AND CONDITIONS
Introduction
Welcome to KaamEzy, a brand of Roamify Traveltech Private Limited ("Agency," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the KaamEzy website, platform, and services related to the recruitment and placement of Domestic Helpers ("Services").
By accessing our website, using our Services, requesting a Domestic Helper placement, or clicking a box indicating your acceptance of these Terms, you ("Client," "You," or "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.
1. Definitions
In these Terms, unless the context otherwise requires:
1.1 "Agency" means KaamEzy, a brand of Roamify Traveltech Private Limited, the provider of the Services.
1.2. "Client" or "You" means the individual accessing or using the Agency's Services and accepting these Terms.
1.3. "Confidential Information" includes, but is not limited to, personal details of the Domestic Helper provided by the Agency, your personal information, terms of service, pricing, and any non-public information disclosed by one party to the other.
1.4. "Domestic Helper" means an individual sourced by the Agency for potential placement with You to perform tasks including, but not limited to, brooming, mopping, cooking, childcare, elderly care, driving, washing utensils, washing clothes, dusting, and bathroom cleaning. Domestic Helpers may be placed for Permanent Placement or Temporary Placement.
1.5. "Fees" means the charges payable by You to the Agency for the placement services as detailed in Clause 5.
1.6. "Force Majeure Event" means any event beyond the reasonable control of the Agency, including acts of God, war, riots, civil unrest, strikes, lockouts, epidemics, pandemics, government restrictions, failure of public utilities, or internet service disruptions.
1.7. "Guarantee Period" means a period of 3 (Three) months applicable only to Permanent Placements, commencing from the first day the Domestic Helper starts working for You following the Trial Period, subject to the conditions herein.
1.8. "Negotiated Salary" means the monthly remuneration mutually agreed upon between You and the Domestic Helper for a Permanent Placement.
1.9. "Permanent Placement" means the placement of a Domestic Helper intended for ongoing, regular service, where the helper works for specific hours daily or as per a live-in arrangement, based on a Negotiated Salary.
1.10. "Services" means the recruitment, screening, and placement facilitation services provided by the Agency as described herein.
1.11. "Temporary Placement" means the placement of a Domestic Helper for a fixed, short-term duration, typically charged at a daily rate quoted by the Agency.
1.12. "Terms" means these Terms and Conditions, including the Privacy Policy and any other referenced documents, as amended from time to time.
1.13. "Trial Period" means an initial paid trial period of:
a. Three (3) calendar days for standard Domestic Helper placements.
b. Seven (7) calendar days for 24-hour, live-in Domestic Helper placements.
This period commences on the first day the Domestic Helper reports for duty with You.
2. Scope of Services
2.1. You engage the Agency to assist in identifying, screening, and proposing suitable Domestic Helper candidates based on the requirements You provide.
2.2. The Agency acts solely as an intermediary. The final decision to engage a Domestic Helper rests with You. The Agency does not employ Domestic Helpers.
3. Your Obligations
3.1. You shall provide accurate information regarding required services, working conditions, and expected remuneration.
3.2. You shall interview candidates and make the final selection for the Trial Period.
3.3. You are responsible for paying the Domestic Helper directly for services rendered (including the Trial Period) and for agreeing upon employment terms (hours, duties, remuneration, leave) directly with them. Typical number of leaves is 2 days per month
3.4. You shall provide a safe and respectful working environment.
3.5. You acknowledge the Agency's verification limits (Aadhaar for identity only) and your responsibility for any further background checks (e.g., police verification).
3.6. You shall pay the Agency's Fees promptly as per Clause 5.
4. Agency Obligations
4.1. We will use reasonable efforts to source and screen candidates matching your stated requirements.
4.2. We will conduct Aadhaar verification for Indian Domestic Helpers (identity confirmation only).
4.3. Optional 'Criminal Records Verification Report' may be offered via partners at an additional cost.
4.4. We will facilitate communication during the selection process.
4.5. We will provide replacement services during the Guarantee Period (Permanent Placements), subject to these Terms.
5. Fees and Payment Terms
5.1. Permanent Placement Fee: You agree to pay the Agency a one-time Fee of 50% of the first month's Negotiated Salary agreed between You and the Domestic Helper.
5.2. Temporary Placement Fee: You agree to pay the Agency a Fee of 15% of the total daily rate quoted by the Agency multiplied by the number of days the Temporary Placement is engaged for (Minimum Fee: INR 50).
5.3. Invoicing: After the Trial Period confirmation (for Permanent Placements), we will issue an invoice for the applicable Fee.
5.4. Payment Due Date: You must pay the invoiced Fee in full within three (3) calendar days of receiving the invoice.
5.5. Consequences of Non-Payment:
a. Failure to pay within 3 days voids the Guarantee Period eligibility.
b. Failure to pay constitutes a breach. We reserve the right to inform the placed Domestic Helper of other opportunities, potentially impacting your service continuity, for which we bear no liability.
5.6. Additional Fees for Salary Increase: If the Domestic Helper's salary increases during the Guarantee Period, we reserve the right to invoice You for 50% of the incremental monthly salary amount. This also applies if a replacement Helper is engaged at a higher salary during the guarantee period.
6. Trial Period (Permanent Placements Only)
6.1. Placements start with the applicable paid Trial Period (3 days standard, 7 days live-in).
6.2. Continuation requires mutual agreement between You and the Domestic Helper after the Trial Period.
6.3 Continuation & Payment for Trial: If both parties mutually agree to continue post the trial period, You are still obligated to pay the Domestic Helper for the trial days worked, calculated as: (Agreed Monthly Salary / 30) * Number of Trial Days Worked.
6.4. Non-Continuation & Payment for Trial: If either party declines to continue, You must immediately pay the Domestic Helper for trial days worked, calculated as: (Agreed Monthly Salary / 30) * Number of Trial Days Worked.
6.4. Condition for Replacement Trial: We will only provide a replacement candidate after You confirm payment for the previous Helper's completed Trial Period.
7. Guarantee Period (Permanent Placements Only)
7.1. A 3-month Guarantee Period applies, contingent on timely Fee payment.
7.2. Replacement: If the placement ends during the Guarantee Period due to Helper departure or Client dissatisfaction (valid reasons), we will make reasonable efforts to provide suitable replacements at no extra Agency Fee.
7.3. Refund: A refund of the Agency Fee will be provided only if we cannot offer a suitable replacement within seven (7) calendar days of the previous Helper's departure (under Clause 7.2).
7.4. No Refund: No refund if You terminate and decline a replacement, or if You are unresponsive to replacement offer(s) for 7 days.
7.5. Guarantee for Replacement: Covers the balance of the original 3-month period.
7.6. Additional Fees for Salary Increase of Replacement Helper: If a replacement Helper is engaged at a higher salary during the guarantee period, we reserve the right to invoice You for 50% of the incremental monthly salary amount.
8. Limitation of Liability & Disclaimers
8.1. The Agency acts solely as an intermediary. The employment relationship is between You and the Domestic Helper.
8.2. We are not liable for any loss, damage, cost, expense, injury, or death arising directly or indirectly from any act, omission, misconduct, negligence, or default of the Domestic Helper engaged by You.
8.3. We make no warranties regarding the Helper's reliability or conduct beyond our stated screening.
8.4. We are not responsible for Client-Helper disputes (but may mediate) or for recovery of loans/advances You give to the Helper.
9. Confidentiality
9.1. We will handle your personal information as per our Privacy Policy. You agree to keep the personal details of Domestic Helper candidates provided by the Agency confidential and use them solely for evaluating their suitability for employment with you. You shall not disclose this information to third parties without the Agency's prior written consent.
10. Term and Termination
10.1. These Terms are effective upon your acceptance and continue until terminated.
10.2. Termination by You: You may stop using the Services at any time by notifying the Agency. Termination does not affect your obligations regarding engaged Helpers or outstanding Fees.
10.3. Termination by Agency: We may suspend or terminate your access to the Services immediately upon notice if You breach these Terms (including non-payment, providing unsafe work environment, or misusing confidential information). We may also terminate for convenience with reasonable notice.
10.4. Consequences: Upon termination, outstanding Fees become due. Obligations under confidentiality and liability limitations survive termination.
11. Dispute Resolution
11.1. In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services ("Dispute"), the parties shall first attempt to resolve the Dispute amicably through mutual negotiation in good faith.
11.2. If the Dispute cannot be resolved through negotiation within thirty (30) days, the Parties agree that the courts of Mumbai shall have exclusive jurisdiction to settle any Dispute.
12. Force Majeure
12.1. The Agency shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by a Force Majeure Event. We will notify you if such an event occurs.
13. Notices
13.1. Notices from the Agency to You may be provided via email to the address You provided during registration, or by posting updates on the KaamEzy website/platform. You are responsible for keeping your email address current.
13.2. Notices from You to the Agency must be sent via email to: [kaamezy@gmail.com].
14. Miscellaneous
14.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
14.2. Exclusive Jurisdiction: You agree to submit to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
14.3. Entire Agreement: These Terms (including the Privacy Policy and any other documents expressly incorporated by reference) constitute the entire agreement between You and the Agency regarding the Services and supersede all prior discussions or agreements.
14.4. Amendments: We reserve the right to modify these Terms at any time. We will notify You of significant changes by posting the revised Terms on our website or by email. Your continued use of the Services after such notification constitutes your acceptance of the amended Terms.
14.5. Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.
14.6. Waiver: Failure by the Agency to enforce any provision of these Terms shall not constitute a waiver of its right to do so later.
